1.     LEGAL INFORMATION

 

The website https://stingmapper.com (the “Website”), including the Portal STINGMAPPER (the “Portal”), and the mobile application STINGMAPPER (the “Application”) are made available by:

The Website, the Application, and the Portal are made available to deliver the “Services” to the Users.

 

2.     HOSTING

3.     DEFINITIONS

 

For the purpose of these Terms of Use (the “Terms”), the following terms beginning with a capital letter shall have the meaning as defined below:

 

a)    Account: the personal account created by a User in order to access certain functionalities of the Services;

 

b)    Application: the Stingmapper mobile application, which main feature is to allow Users to report and view the location of hornet nests and traps;

 

c)    Contract: the subscription agreement and any related documents, including the Order Form, concluded between the User and the Publisher, defining the applicable terms, conditions and scope of the Services;

 

d)    License: the rights granted to the User to access and use the Services within the limits set forth in these Terms;

 

e)    Order Form: the document issued by the Publisher and accepted by the User prior to the Subscription, specifying in particular the subscribed Services, pricing, duration and any specific conditions applicable to the Contract;

 

f)      Portal: the web-based platform operated by the Publisher, which is accessible via a browser and which allows certain Users to access additional features. The Portal is a dedicated section of the Website;

 

g)    Services: all features as made available through the Website, the Application and the Portal, which access may be restricted to specific categories of Users in accordance with the detailed Service specifications are defined in the Contract;

 

h)    Source Code: the human-readable form of the relevant software consisting of programming instructions and documentation that allow developers to understand, modify and maintain the software;

 

i)      Subscription: a paid plan granting access to specific features of the Services for an agreed period, subject to the terms of the Subscription Agreement. The available Subscription options are detailed in the Order Form prior to the conclusion of the Subscription;

 

j)      Subscription Agreement: order form incorporating the terms applicable to the specific Services offered to a User based on his/her specific profile and chosen Subscription plan.

 

k)     Technical Guide: the document provided to authenticated Users, detailing the functionalities, technical requirements, and interoperability of the Services, communicated as an annex to the Contract and/or made available in the User’s personal space;

 

l)      User: any individual or legal entity using the Services, in accordance with the granted License. Depending on his/her profile, the User may access either the only Services as available on the Application, or both the Application and the additional Services as made available on the Portal. The different sections relating to each type of User are accessible on the Website.

 

m)  User Content: any data, observation, photograph, comment, geolocation or other information submitted by Users through the Services;

 

n)    Website: the website operated by the Publisher at https://stingmapper.com.

 

4.    PURPOSE OF THE SERVICES

 

The Application is a collaborative tool allowing users to:

 

-          map hornet traps and nests;

-          report hornet nests to the community of Users;

-          register traps;

-          add observations, photographs and comments;

-          consult reports submitted by other Users;

-          check for professional neutralizers active in the geographical area where a nest is located.

 

Certain users may also benefit from additional features through the Portal, including:

 

-          management of information related to beehives;

-          monitoring of nest eradication actions;

-          access to specific mapping data;

-          downloading of specific data sets for scientific purposes.

 

The detailed features of the Services are described in the Technical Guide.

 

5.     SERVICE CONDITIONS

 

The available features may vary depending on the User profile.

 

Certain Users may benefit from access to additional features through the Portal, including:

 

-          beekeeper;

-          professional hornet nest neutralizer;

-          public authority;

-          scientific researcher.

 

The various User profiles and their associated Service access conditions are presented through dedicated sections on the Website.

 

6.     SUBSCRIPTION AGREEMENT

 

For specific User profiles, the Services shall be subject to a prior Subscription.

 

Where applicable, a Subscription Agreement shall be concluded between the Publisher and the User.

 

The Subscription Agreement may define specific conditions regarding in particular the duration of the services, pricing, or the scope of the provided Services.

 

In the event of an inconsistency or contradiction between these Terms and the provisions of the Subscription Agreement, the latter shall prevail.

 

7.     ACCESS TO THE SERVICES

 

By creating an Account or using the Services, the User acknowledges to have read and accepted these Terms as legally binding for the provision and use of the Services.

 

Access to certain features of the Services requires the creation of an Account or the signature of a Subscription Agreement.

 

Creating an Account requires the provision of (i) an email address and (ii) a password.

 

The User is solely responsible for maintaining the confidentiality of his/her login credentials and also for any activity carried out through the use of his/her Account.

 

Certain features of the Application may require to access and/or use specific features of the User’s personal device, including (i) geolocation features and (ii) the camera related features.

 

Such access is subject to the User’s prior authorization through his/her device settings. Disabling the access to required device features may prevent the Application to deliver its expected features.

 

8.     INTELLECTUAL PROPERTY AND LICENSE TO USE THE SERVICES

 

The Publisher remains the sole owner of all intellectual property rights relating to the Services, including the Website, the Application, the Portal, databases, interfaces and associated technologies. Nothing in these Terms shall be interpreted as transferring any ownership rights to the User.

 

Subject to the strict compliance with these Terms, the Publisher grants the User a limited, personal, non-exclusive, and non-assignable License to access and use the Services for their own individual purposes.

 

The Service features are detailed on the Website and are subject to updates, depending on the commercial strategy of the Publisher.

 

In case of update which would prevent the use of a key feature for the User, this latter shall be allowed to terminate his/her Subscription Agreement in accordance with the conditions set forth in Article 18.

 

The License granted to the User:

 

-          is strictly limited to the use of the Services made available by the Publisher;

-          does not grant any right to access or obtain the Source code of the the Website, the Application, the Portal, databases, interfaces and associated technologies;

-          does not allow the User to reproduce, distribute, modify, adapt, reverse engineer or attempt to extract the Source code of the Website, the Application, the Portal, databases, interfaces and associated technologies, except where permitted by applicable law.

 

Unless expressly authorized by the Publisher, the User shall not:

 

-          sell, rent, sublicense or commercially exploit the Services;

-          make the Services available to third parties through any interface, API, web service or automated system;

-          use the Services in a manner that could interfere with their proper functioning or security.

 

Any use of the Services in violation of these restrictions may result in the immediate suspension or termination of the User’s access to the Services.

 

 

 

 

 

9.     SERVICE CONDITIONS

 

9.1.  Subscription

 

Access to certain advanced features of the Portal shall be subject to the conclusion of a Subscription Agreement.

 

The scope of the functionalities included in each Subscription plan is defined in the Contract, including the Order Form.

 

In case of discrepancy between these Terms and the Contract, the Contract shall prevail.

 

 

9.2.  Duration and renewal

 

Unless otherwise specified, Subscriptions are concluded for a fixed period of one (1) year from the date of activation.

The Subscription does not renew automatically.

 

Prior to the expiry of the Contract, the User will receive a renewal proposal. The User may choose to renew the Subscription by accepting the proposal and proceeding with the corresponding payment, or to refuse it, in which case the Subscription will terminate at the end of the current period.

 

The User may terminate the Subscription in accordance with Article 17.

 

 

9.3.  Financial terms

 

The Subscription price applicable to the Services is indicated on the Subscription Agreement and on the Website.

 

Subscriptions are payable annually through the payment methods made available by the Publisher.

 

The Publisher reserves the right to modify the Subscription price at the end of each Subscription period. Any price modification shall be communicated to the Users through an email notification using the contact email address as specified by the User in the Subscription Agreement.

 

If the User does not accept the updated price, the User may terminate the Subscription Agreement prior to the expiry of the current Subscription term.

 

In the event of non-payment, the Publisher reserves the right to suspend access to the Services until full payment of the amounts due.

 

10.  ACCOUNT MANAGEMENT

 

The User is solely responsible for the management and security of his/her Account.

 

The User undertakes to keep login credentials confidential and not to share them with third parties.

 

The User is responsible for all activities carried out through their Account.

 

The Publisher reserves the right to suspend or terminate an Account if it is used in violation of these Terms, applicable laws, or the rights of third parties.

 

11.  USER CONTENT

 

The Application allows Users to submit content, including observations, geolocation data, photographs and other information related to hornet nests or traps.

 

By submitting such content, the User grants the Publisher a worldwide, non-exclusive, royalty-free license to use, reproduce, store, analyse, display and process such content for the purposes of:

 

-          operating and improving the Services;

 

-          maintaining the accuracy of the mapping functionalities;

 

-          scientific, environmental or statistical analysis in relation with invasive species monitoring.

 

The User represents that they have the necessary rights to submit such content and that the content does not infringe the rights of any third party.

 

12.  NO WARRANTY ON INFORMATION

 

Information displayed on the map is based in particular on reports submitted by Users.

Such information is provided for informational purposes only.

 

The Publisher does not guarantee the accuracy, the completeness, or the up-to-date nature of the information accessible via the Services.

 

Users remain solely responsible for verifying information before taking any action or making decisions based on it.

 

The Publisher shall not be liable for any damages resulting from actions taken by Users or third parties on the basis of information available through the Services.

 

13.  REPORTING CONTENT

 

Any person who believes that content or a report published through the Services infringes their rights or is unlawful may request its verification or removal by contacting the Publisher using the reporting address : https://www.stingmapper.com/signaler-un-contenu-inapproprie.

 

The Publisher reserves the right to remove any manifestly unlawful or inaccurate content.

 

Users refrain from sending abusive or false content reporting to the Publisher. In case of repeated sending of false/abusive reporting to the Publisher, this latter may decide to suspend or terminate the User’s access to the Services.

 

14.  MAINTENANCE AND AVAILABILITY

 

The Publisher undertakes reasonable efforts to ensure the availability of the Services.

 

However, the Services may be temporarily interrupted, in particular for : (i) maintenance ; (ii) updates ; (iii) technical improvements.

 

Such interruptions shall not give rise to any compensation.

 

The Publisher may also carry out scheduled maintenance operations intended to improve the security, stability or functionality of the Services.

 

The Publisher reserves the right to modify, update or improve the features of the Services at any time.

 

The Publisher may temporarily suspend access to the Services where necessary to ensure the security, integrity or proper functioning of the Services.

 

15.  LIABILITY

 

The Services are provided “as is.”

 

The Publisher is subject only to a best-efforts obligation.

 

The Publisher shall not be held liable in particular for:

 

-          inaccurate information submitted by Users;

-          indirect damages ;

-          service interruptions ;

-          problems related to internet access or User equipment.

 

Except in the case of gross negligence or personal injury, the Publisher’s liability shall be limited to the amount of Subscription fees already paid by the User during the previous twelve (12) months.

 

16.  PERSONAL DATA

 

The use of the Services involves the processing of certain personal data.

17.  TERMINATION

 

Termination shall take effect at the end of the current Subscription period.

 

The Publisher reserves the right to suspend or terminate a User’s access to the Services in the event of a non-compliance of the User with these Terms.

 

The Publisher may also terminate the Subscription at any time for legitimate reasons, including in particular in the event of termination of the Services, subject to reasonable prior notice.

 

In case of increase of the Service price, the User may terminate the Subscription Agreement until the expiry of the current Subscription period, without any prior notice period. Any termination request must be sent by e-mail to the following address: contact@stingmapper.com.

 

Termination of the Subscription results in the loss of access to the Service features subject to a Subscription Agreement.

 

Termination shall not affect the obligations accrued prior to the termination date.

 

18.  SUBCONTRACTING

 

The Publisher may use subcontractors for the provision of the Services.

 

The Publisher may also transfer or assign all or part of the rights and obligations deriving from these Terms and Subscription Agreements to any entity ensuring the performance of the Services, provided that such transfer does not affect the rights of consumer Users.

 

The User may not assign his/her rights or obligations under these Terms without the prior written consent of the Publisher.

 

19.  SEVERABILITY

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

20.  APPLICABLE LAW AND JURISDICTION

 

These Terms are governed by Belgian law.

In the event of a dispute:

-          for consumers, the courts of the User’s place of residence shall have jurisdiction;

-          for professional users, the courts of the judicial district of the Publisher’s registered office shall have jurisdiction.
